What Is Local Law 126 in the Bronx?

Local Law 126 is the New York City law that requires owners of parking garages to have their structures inspected on a regular cycle. The inspection must be done by a Qualified Parking Structure Inspector, a New York State licensed professional engineer approved by the Department of Buildings, who examines the slabs, columns, beams, ramps, barriers, joints, and drainage and files a condition assessment report with DOB. That report rates the garage Safe, SREM, or Unsafe and lists every condition that needs repair, along with the timeframe for fixing it.

For Bronx owners, the timing matters right now. Bronx garages are in the current filing window, so co-op boards, managing agents, and building owners across the borough are booking inspections and planning repairs at the same time. Between inspections, every garage also needs a yearly observation based on the checklist in its report. The law doesn't end with the report. It ends when the repairs are done and the inspector confirms them.

Safe, SREM and Unsafe Ratings Explained

Every Local Law 126 report places the garage in one of three categories, and each one comes with a different set of next steps.

Safe

No conditions need repair before the next inspection. The garage still needs its yearly observation and routine maintenance to stay that way.

SREM

Safe with Repairs or Engineering Monitoring. The garage is safe today, but the listed conditions must be repaired within the timeframe the inspector sets. If they're not fixed by the next inspection, they're reported as Unsafe.

Unsafe

A condition poses a danger right now. DOB is notified, protective measures go in immediately, and repairs generally have 90 days unless the inspector sets a different timeframe.

Why Bronx Parking Garages Deteriorate

Most of the damage found in Local Law 126 inspections comes from the same few causes.

Road Salt & Water

Cars carry salt and slush onto the decks, and salty water soaks into the concrete and rusts the steel inside.

Freeze-Thaw Cycles

Water trapped in cracks freezes and expands every winter, breaking the concrete apart a little more each year.

Aging Concrete & Steel

Many Bronx garages are decades old, and failing joints, coatings, and drainage leave the structure exposed.

Local Law 126 FAQs for Bronx Garage Owners

What is Local Law 126?

Local Law 126 is the NYC law that requires parking garages to be inspected by a Qualified Parking Structure Inspector on a regular cycle. The inspector files a condition assessment report with DOB, rates the garage Safe, SREM, or Unsafe, and lists the repairs needed and when they must be done.

Does Local Law 126 apply to my Bronx garage?

Most parking garages in apartment buildings, co-ops, condos, and commercial properties are covered, whether the garage is below the building or stands on its own. A few small types are exempt, and a QPSI can confirm whether yours is included.

When is the Bronx deadline?

Bronx garages are in Sub-Cycle 1C, which requires condition assessment reports to be filed with DOB by December 31, 2027. Starting early leaves time to schedule the inspection and complete any repairs the report calls for.

Who can inspect a parking garage under Local Law 126?

Only a Qualified Parking Structure Inspector. A QPSI is a New York State licensed professional engineer with at least three years of parking structure experience who has passed a DOB evaluation. We work with licensed QPSI partners, and our team handles the repairs.

What happens if my garage is rated Unsafe?

The inspector notifies DOB right away, and protective measures such as shoring or closing off areas must go in immediately. Unsafe conditions generally must be repaired within 90 days unless the inspector sets a different timeframe, and the QPSI files an amended report within two weeks of the repairs.

What if SREM conditions are not repaired in time?

SREM conditions that are not fixed by the next inspection must be reported as Unsafe, and the owner can face penalties. Completing SREM repairs within the timeframe in your report avoids both.

What are the penalties for not filing?

Owners who miss the filing deadline can face late filing penalties of $1,000 per month, and DOB can issue failure-to-file violations carrying $5,000 per year. Filing as soon as possible stops the penalties from growing.

What is the yearly observation?

Between full inspections, every garage needs a yearly observation based on the checklist in its last report. It is done by or under the supervision of a QPSI, and it helps catch problems before they become SREM or Unsafe conditions.
